1. Agreement & Acceptance

By accessing or using the CUSKIN Australia website at cuskin.com.au (the “Site”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to all of these Terms, you must not use the Site. We reserve the right to update these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

2. Definitions

  • “Site” means the CUSKIN Australia website, including all pages, content, and services available at cuskin.com.au.
  • “We”, “Us”, “Our” means CUSKIN Australia Pty Ltd.
  • “You”, “Your” means the individual accessing or using the Site.
  • “Products” means the cosmeceutical skincare products listed for sale on the Site.
  • “Order” means a request by you to purchase Products through the Site.

3. Eligibility

You must be at least 18 years of age to make a purchase on the Site. Persons aged 16 or 17 may use the Site with the consent and supervision of a parent or legal guardian. By placing an Order, you represent and warrant that you meet these eligibility requirements.

4. Products & Information

We make every effort to display our Products accurately on the Site, including descriptions, ingredients, and images. However:

  • Product colours and appearances may vary slightly due to screen settings and photography.
  • Our Products are cosmeceutical skincare products, not therapeutic goods. Results may vary between individuals. Product descriptions and claims are not intended as medical advice and should not be relied upon as a substitute for professional medical treatment.
  • If you have concerns about ingredients or skin sensitivities, we recommend performing a patch test before use and consulting a healthcare professional if necessary.

5. Orders & Acceptance

Placing an Order through the Site constitutes an offer by you to purchase the selected Products. All Orders are subject to acceptance by us. We may refuse or cancel any Order at our discretion, including but not limited to:

  • Product unavailability or stock shortages
  • Errors in product or pricing information
  • Suspected fraudulent or unauthorised transactions
  • Orders that appear to be for resale purposes

If we cancel your Order after payment has been processed, we will issue a full refund to your original payment method.

6. Pricing & Payment

  • All prices are displayed in Australian Dollars (AUD) and are inclusive of GST (Goods and Services Tax) at 10%.
  • Payment is processed securely through Stripe. We do not store your credit card details on our servers.
  • We reserve the right to correct pricing errors. If a Product is listed at an incorrect price due to a technical error, we will notify you and offer the option to proceed at the correct price or cancel for a full refund.
  • Prices are subject to change without notice, but changes will not affect Orders already confirmed.

7. Shipping & Delivery

  • We currently ship within Australia only.
  • Standard shipping is estimated at 2–5 business days, depending on your location.
  • Free shipping is available on all Australian orders over A$80.00.
  • A flat-rate shipping fee of A$9.95 applies to orders under A$80.00.
  • Delivery timeframes are estimates only and are not guaranteed. We are not liable for delays caused by the carrier, weather events, or other circumstances beyond our reasonable control.
  • Risk of loss and title for Products passes to you upon delivery to the shipping address provided.

8. Returns & Refunds

Our returns and refunds policy is detailed on our Returns & Refunds page. By making a purchase, you acknowledge and agree to the terms of that policy.

9. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms is intended to exclude, restrict, or modify your rights under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other applicable consumer protection legislation.

10. Intellectual Property

All content on the Site — including text, images, graphics, logos, product names, and the CUSKIN brand — is the property of CUSKIN Australia Pty Ltd or its licensors and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

11. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You must notify us immediately of any unauthorised use of your account.
  • We reserve the right to suspend or terminate your account at any time if we reasonably believe that your account has been used in breach of these Terms or for fraudulent or unlawful activity.

12. Limitation of Liability

To the maximum extent permitted by law, CUSKIN Australia Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site or purchase of Products.

Our total liability to you for any claim arising from or related to a purchase shall not exceed the total amount paid by you for the applicable Order. This limitation does not apply to, and nothing in these Terms excludes or limits, any rights you have under the Australian Consumer Law or other statutory consumer guarantees.

13. Indemnification

You agree to indemnify, defend, and hold harmless CUSKIN Australia Pty Ltd, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, misuse of the Site, or violation of any applicable law.

14. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

15. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, supply chain disruptions, carrier delays, or internet outages.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and any courts of appeal therefrom.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
